What is the Grant of an Examined Patent?

Patent registration procedures are carried out by the Turkish Patent Institute, either by individuals or through their representatives. According to Article 42 of the regulations issued by the KHY for patent registration, the necessary documents and processes for the application are as follows: an application petition, a description that best explains the subject of the invention, drawings referred to in the claim(s) in the description, and the claim(s) covering the element(s) of the invention for which patent protection is sought are required. Patent and trademark attorneys provide the necessary services in these areas. The TPE also publishes a search report for the known state of the art. After the publication of this required search report, third parties may file objections stating that the patentability conditions are not met. In the event of objections, the petition of objection and its annexes are sent to the applicants, and the applicants must respond within 3 months from the notification of the objections. Necessary services are provided by the trademark attorney.

How is an Unexamined Patent Granted?

Based on the preparation of the search report by the TPE, third parties must generally notify the TPE of their views on the search reports within a 6-month period. At this point, there is no objection, and the statements of third parties who only provide opinions are forwarded to the applicants, who must also provide their thoughts on these opinions. This decision is published in the official patent bulletin. Information regarding any issues or necessary procedures is provided by the trademark attorney.
