Member Countries
It is a protocol related to trademark registration, stemming from the Madrid Agreement adopted on December 1, 1995, and in effect since January 1, 1999. With this protocol, Turkish companies will be entitled to obtain international registration of their trademarks. This protocol is valid in 66 countries. To have your trademark registered internationally, it must first be approved in Turkey. A trademark whose registration is not approved in Turkey cannot be registered abroad. With a single application to this protocol, your trademark is protected in all protocol member countries.
For 5 years, the Madrid Protocol will be dependent on the registration in Turkey, meaning if a cancellation or similar situation occurs in Turkey, the procedures applied in Turkey will also be valid under the Madrid Protocol.
After Application
After 5 years, the registration process will continue independently of Turkey. Within 12-18 months, the trademark owner will be notified whether the trademark registration has been approved or not, or in which countries it has been accepted and in which it has been rejected. The application fee for the Madrid Protocol is paid to the Turkish Patent Institute by converting the Swiss Franc value to Turkish Lira.
If countries join the protocol after the registration process, the trademark owner can ensure the validity of the registration in those countries by paying an additional fee to make the registration valid there as well. International registration is valid for 10 years, just like in Turkey, and this period can be extended later by paying additional fees.
